By accessing and using SpeakTales ('Service', 'Platform', 'we', 'us', or 'our'), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Service Description

SpeakTales is an AI-powered platform that generates personalized children's stories with professional voice narration. Users provide text descriptions, and our AI creates complete narratives with character voices and audio narration. The Service is intended for personal, non-commercial use unless otherwise agreed in writing.

3. User Accounts

You must create an account to use certain features of the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must not share your account credentials with others or allow others to access your account. You are solely responsible for any actions taken through your account.

4. Age Requirements and Parental Consent

The Service is intended for use by individuals 18 years of age or older. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian. Parents and guardians are responsible for monitoring their children's use of the Service and the content they create or access.

5. Intellectual Property and Content Rights

All intellectual property rights in the Service, including but not limited to software, design, text, graphics, and AI models, are owned by SpeakTales or our licensors. These rights are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

You retain ownership of the text descriptions you provide ('User Content'). By using the Service, you grant us a worldwide, royalty-free license to use, reproduce, and process your User Content solely to provide the Service and generate stories. AI-generated stories and audio are licensed to you for personal use but remain subject to our intellectual property rights in the underlying AI technology.

6. Prohibited Uses

• Creating content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringing on intellectual property rights of others
• Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity
• Attempting to gain unauthorized access to the Service, other accounts, or computer systems
• Using automated means (bots, scrapers) to access the Service without our express written permission
• Interfering with or disrupting the Service or servers or networks connected to the Service
• Using the Service for any commercial purpose without our prior written consent
• Creating content that violates any applicable laws or regulations

7. Payment and Subscriptions

Access to certain features may require a paid subscription. Subscription fees are charged in advance on a recurring basis according to your chosen billing cycle (monthly or annually).

By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for maintaining valid payment information and paying all charges on time.

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and you will retain access to premium features until that time.

Subscription fees are generally non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to modify pricing with reasonable notice to existing subscribers.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease, and we may delete your account and content without liability.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. AI-generated content may contain errors, inaccuracies, or inappropriate material despite our content filtering efforts.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPEAKTALES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the 'Last Updated' date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
